This is the privacy policy of Technical Risk Services Inc. (TRS). This document explains TRS’ policies for the collection, use and disclosure of (“Personal Information”). Our goal is to protect your privacy and the confidentiality of your Personal Information.

TRS shall comply with all applicable laws regarding the protection of Personal Information, including the Personal Information Protection and Electronic Documents Act. Where the Customer transfers Personal Information to TRS, the latter shall (i) use the Personal Information only as required to perform its obligations hereunder, (ii) limit access to the Personal Information to those within its organization who need it to perform TRS’s obligations hereunder, (iii) not disclose the Personal Information to any third party, except as necessary to perform the Services, as instructed by the Customer, and (iv) comply with the Customer’s instructions regarding the destruction or return of the Personal Information to the Customer.

Definition of Personal Information
For the purpose of this policy, Personal Information refers to any information, factual or subjective, recorded under any form, about an individual, and which allows this individual to be identified. Personal Information includes, the name, birth date, gender, religion, income, home telephone number, personal mobile telephone number, home address, personal e-mail address, personal fax number, social insurance number/social security number, financial or health information and opinions about an individual. However, Personal Information does not include an individual’s “business contact information”, which comprises an individual’s name, position name or title, business telephone number, business address, business e-mail, business fax number and other similar business information.

The Information We Collect
TRS will only collect Personal Information that is necessary for completing customer requests for products and services. The main purpose of collecting information is to assist in the assessment and reporting on commercial risk conditions. We may also collect information to assist us in improving our services, or complying with requests of law enforcement agencies or regulators.

Consent
Except where permitted or required by law, TRS will only collect, use and disclose Personal Information with the knowledge and consent of the individual. TRS will use the form of consent, either express or implied, that reflects the nature of the information being collected, taking into account its sensitivity and reasonable expectations of the individual.

All Personal Information will be collected by fair and lawful means.

An individual may withdraw his/her consent at any time with respect to the continuing use or disclosure of his/her Personal Information, subject to legal or contractual restrictions and reasonable notice, by writing the Privacy Officer at the address below. Withdrawing consent may result in our inability to continue providing products and services but we will advise you of any issues arising from this decision.

Use of Personal Information
TRS will only use Personal Information to assist with the provision of our products and services including customer service, accounting, billing, collections and the marketing of other products and services.

We may use web-based tools when you visit our websites to track your online activities, including your registration, submissions, and information requests, in accordance with applicable law. We may also use your IP address to help diagnose problems with our server and to administer our website. We use Personal Information to register you with the website and our Work Management System (WMS) which enables you to order and receive requested products and services. We may occasionally use your contact information to send you information and updates about TRS or to invite you to various functions and training. You may also opt out of receiving marketing information from us, including email, direct mail, and phone solicitations, by calling us at 1-888-877-7475 during normal business hours.

Disclosure of Personal Information
TRS will only use and disclose Personal Information for the purpose for which it was collected. TRS will only retain Personal Information as long as is necessary for the fulfillment of the purpose identified as well as legal purposes.

Accuracy
Where TRS collects Personal Information TRS shall take appropriate measures to ensure that the Personal Information is accurate, complete, and up to date as is necessary to fulfill the purpose for which the information is to be used.

Safeguards
TRS will protect your Personal Information from unauthorized use, disclosure, access, copying and modification. Such safeguards may take the form of locked filing cabinets, restricted access to information (physical and on a need-to-know basis, alarm systems or other electronic control devices, technological tools such as passwords, encryption, firewalls, etc.). The selection of safeguards will be determined according to the nature of the Personal Information to be protected.
